November 26, 2012 – San Bernardino officials voted 5-2 Monday afternoon to approve the latest version of a hotly-contested pendency plan that will be provided to the court as part of the city’s bankruptcy filing. Councilman Chas Kelley, who represents the fifth ward, and Third Ward Councilman John Valdivia voted against the pendency plan during the meeting at San Bernardino City Hall. The plan is “incompatible with a lot of my core values,” Valdivia said. It doesn’t incorporate public input, including unfunding police positions, he continued. City Attorney James F. Penman tried to rally council members and gave a speech in favor of them coming together to pass the pendency plan. He said that it was important to show unanimity to the bankruptcy court, even if they don’t agree with all details of plan.
